Who processes your data, and what data
The data controller is Txell Castelló (Baula), at the contact details above. From the contact form we process your name, e-mail address, telephone number if you give one, professional profile, the service you need, the location of the property, the number of properties and whatever you write in the detail field. From the client area we process your e-mail address and the data of the files you have instructed. We do not ask for and do not want special categories of data, and we would be grateful if you did not include any in the detail field.
What we use it for, and on what legal basis
The form data is used solely to answer your enquiry and prepare a quote, on the basis of your consent and of the pre-contractual steps you are requesting (Article 6(1)(a) and 6(1)(b) of the General Data Protection Regulation). If you go on to instruct us, the data is processed to carry out the instruction and to meet the accounting and tax obligations the law places on us (Article 6(1)(b) and 6(1)(c)). We do not profile, we do not take automated decisions and we do not send marketing to people who have not asked for it.
How long we keep it
If the enquiry does not lead to an instruction, we delete the data after one year. If you instruct us, we keep the file for as long as the commercial relationship lasts and then for the statutory limitation periods: six years for commercial books and records (Article 30 of the Spanish Commercial Code) and four years for tax obligations (General Tax Act). After that, it is deleted.
Who else has access, and where the data is hosted
We do not sell or share your data with anyone. It may be accessed, solely in order to provide us with a service and under a data processing agreement, by the IT and accountancy providers we use and by the associate technicians assigned to your file. Those legally entitled to it — the tax authorities, the courts — access it when they require it. This website is hosted by Vercel Inc., which may process connection data in the United States under the standard contractual clauses approved by the European Commission.
Your rights
You may at any time exercise your rights of access, rectification, erasure, objection, restriction of processing and portability, and withdraw any consent you have given, by writing to txell@baula.es and proving your identity. We will reply within one month. If you believe we have not dealt with your request properly, you may complain to the Spanish Data Protection Agency (www.aepd.es, calle Jorge Juan 6, 28001 Madrid) or to the Catalan Data Protection Authority.
Cookies
This website does not use cookies. There is no analytics, no tracking pixel and no advertising. The only thing stored in your browser is the client area's session token, and only if you sign in: it is what saves you from typing your password on every page, it goes away when you sign out and, since it is strictly necessary to provide the service you asked for, we do not have to ask for your consent. The fonts are hosted on this website itself: no third party receives your IP address in order to serve them. The tips page contains YouTube videos: none is loaded until you press play, and from then on it is YouTube (Google) that may set its own cookies, in privacy-enhanced mode. The commercial e-mails we send to businesses carry a one-pixel image and links with a code of our own: they tell us whether the e-mail was opened, which links were clicked and, when a link leads to this website, which pages were viewed during that visit and for how long. This information is tied to the business we wrote to, stores nothing in your browser, goes through no third party and is used only to decide whether a call is worth making. You can object through the unsubscribe link at the foot of every e-mail. Apart from those links, this website does not track its visitors in any way.
Confidentiality of the reports
The photographs and reports for a property are accessible only to the client who holds the file and to the assigned team. They are not published or passed to third parties without written permission. In the client area, who may see what is checked by the server on every request, and a file does not appear there until we publish it. The files themselves are never public: they open through a temporary address that expires after one hour. The data and files of the client area are hosted on Supabase, on servers in the European Union (Ireland).
The newsletter
You only join the newsletter by asking to and then confirming: when you sign up we send you an e-mail with a link, and until you click it you are not on the list and receive nothing. If you never click it, the address is deleted automatically after a month. The legal basis is your consent (article 6.1.a of the General Data Protection Regulation), and in order to be able to demonstrate it we store the date, the IP address, the page you signed up from and the wording that appeared beside the tick box; we keep that for as long as you are subscribed and for one year afterwards, to evidence that the subscription was legitimate. We process your e-mail address, your name if you give it, and your language. Every issue carries a one-click unsubscribe link, with nothing to log into and nobody to write to, and anyone who unsubscribes also stops receiving any other e-mail from us. The list is hosted on Supabase, on servers in the European Union (Ireland), and we neither sell it nor pass it on.
